1. Scope of Application

These Terms and Conditions apply to all orders placed via the online shop www.elevendi.com between the Provider and consumers or business customers. For consumers, the mandatory consumer protection provisions of the country of their habitual residence within the European Union shall additionally apply.

2. Offer and Product Description

The Provider primarily offers vehicle sun protection products. Product images may slightly differ, provided that functionality and quality are not affected.

3. Conclusion of Contract

• “Buy now” constitutes a binding offer by the customer
• The contract is concluded by order confirmation or dispatch of the goods
• Contract language: English
• The contract text is stored and transmitted by e-mail

4. Prices and Shipping Costs

All prices are stated in EUR and include statutory VAT.

Shipping is available exclusively within the European Union to the following countries:
DE, PL, AT, FR, NL, HR, CZ, PT, ES, IT, RO, SK, BG, HU, DK, SE, FI, IE, EE, LT, LV, SI, BE

The shipping costs displayed during checkout are binding.

In the case of price reductions, the lowest price applied to the product within the 30 days prior to the reduction is indicated, in accordance with Directive (EU) 2021/2161 (Omnibus Directive).

4a. Non-Discrimination and Geoblocking

The Provider does not apply unjustified geoblocking or discrimination based on nationality, place of residence or place of establishment within the European Union, in accordance with Regulation (EU) 2018/302.

5. Payment Methods

• Credit card (via payment service provider)
• Bank transfer (advance payment – payment deadline: 7 days)

6. Delivery

Shipping from Poland via DPD / GLS (or comparable courier service)

• Poland: 1–2 business days
• Germany: 3–4 business days
• Austria: 4–5 business days
• Other EU countries: 3–5 business days

If delivery fails due to reasons attributable to the customer, the customer shall bear any additional costs.

7. Retention of Title

Goods remain the property of the Provider until full payment has been received.

8. Right of Withdrawal

The statutory right of withdrawal applies (see Withdrawal Policy here).

9. Warranty

Statutory warranty period of 2 years in accordance with EU law.

10. Liability

Unlimited liability applies in cases of intent, gross negligence or injury to life, body or health.
In cases of slight negligence, liability applies only to breaches of essential contractual obligations and is limited to foreseeable damage.

The Provider is neither obliged nor willing to participate.

13. Applicable Law

For consumers, the applicable law shall be the mandatory consumer protection law of the country of their habitual residence within the European Union.

For business customers, Polish law shall apply.

The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

Withdrawal Policy

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period expires 14 days from receipt of the goods.

Effects of Withdrawal

• Refund of all payments within 14 days from receipt of withdrawal notice
• Refund using the same payment method as the original transaction
• Return shipping costs are borne by the customer
• Refund may be withheld until goods are returned or proof of return is provided
• Customer is liable for diminished value due to unnecessary handling
